A petition was filed before the Hon’ble High Court of Delhi challenging the compensation measures for faulty hip implants. Johnson and Johnson had challenged the scheme approved by the Centre in determining the compensation to the patients who have received faulty hip implants.
The Hon’ble High Court of Delhi decided not to interfere with the matter for time being as the issue related to compensation is still pending before the Hon’ble Supreme Court. Justice Vibhu Bakar said that some matters are important and some are urgent and unfortunately the plea of the petitioner does not fall under any of the categories. Therefore, the court does not think it apposite to pass any order at this stage and the further consideration of the petition is deferred to await the outcome of proceeding in the Supreme Court.
Johnson and Johnson a US-based company had filed the petition challenging the compensation scheme before the High Court few weeks after the Health Ministry approved a formula to calculate the amount of compensation to be received by the patients who have received faulty hip implants. The formula approved by the Ministry of Health to calculate the amount of compensation depends on the age and the level of disability caused to the victim.
